With Thanksgiving dinner still digesting and the end of year holidays fast approaching, I break out The Grinch outfit.

All lawyers and risk managers should have a Grinch costume. When it comes to holiday office parties we are the ones who are in the front line trying to keep things safe, sober, and with limited liability for our companies. And what do we get?

“Don’t be a Grinch.” We become the party-poopers, the killjoys…The Grinch.

Corporate liability for social activities is serious. Individual manager and officer liability is becoming more common place. Unfortunately, in an employment environment, some people don’t follow rules. So Grinches develop your party rules, lay down your policies, and be proud of your role!

We have a great group of professionals who read my site from time to time.

In reply to my blog about insurance for the home-based business, one reader replied:

“This also happens to businesses that start out home based that grow and then move to a new location. I was asked to be an expert on a case where an individual got in the mindset that you describe (basically, I’m too small, I’m protected by my [home owners] policy), then expanded the business, moved to a new location, and still assumed that everything was going to be OK from an insurance standpoint. That person could have avoided major problems if they had simply got some professional advice from a competent insurance agent. As you suggested, the cost of proper protection would have been insignificant.”

A good deal of “grass roots” campaigning by the U.S. Chamber of Commerce to oppose health insurance reform.

According to a Bloomberg article, using tax returns and other sources, $86.2 million was funneled to the U.S. Chamber of Commerce to lobby against health insurance reform. In October 2009, America’s Health Insurance Plans (the insurers’ lobby) President and CEO, Karen Ignagni, was quoted as stating, “Health plans strongly support comprehensive, bipartisan health care reform and have proposed sweeping insurance market reforms and new consumer protections to ensure that every American has guaranteed access to affordable health care coverage.”

On occasion in my practice I work with the home-based business owner. Frequently, the discussions center around proper business set up and proper business entity selection. Limiting personal liability, collections, and compliance issues are discussed.

And then…I ask “the” question. Does the business have insurance?

Surprise frequently follows. Then a discussion of why, the owner believes, they do not need business insurance for a home-based business.
